1. Agreement to Terms

By accessing or using JessAI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the App.

2. Description of Service

JessAI is an artificial intelligence-powered mobile application that allows users to upload photos and generate landscape renderings. The service uses AI technology to transform your images into artistic landscape variations.

3. User Accounts

To use certain features of JessAI, you may be required to create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your account credentials
Promptly notify us of any unauthorized use of your account
Be responsible for all activities under your account

4. Acceptable Use

You agree to use JessAI only for lawful purposes. You may not:

Upload images that violate copyright, trademark, or other intellectual property rights
Upload images containing illegal, harmful, threatening, abusive, or defamatory content
Upload images containing pornographic, obscene, or otherwise inappropriate material
Use the service to harm minors in any way
Attempt to reverse engineer, hack, or compromise the security of the App
Use automated systems to access or use the service
Violate any applicable local, state, national, or international law

5. Intellectual Property Rights

You retain ownership of the original images you upload to JessAI. By uploading images, you grant us a limited, non-exclusive license to process your images for the purpose of providing our service.

Generated landscape images created by our AI technology are owned by you, subject to these Terms. JessAI retains all rights to the underlying AI technology, algorithms, and software.

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using JessAI, you consent to the collection and use of your information as described in our Privacy Policy.

7. Service Availability

We strive to maintain high service availability, but we cannot guarantee uninterrupted access to JessAI. The service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control.

8. Termination

We may terminate or suspend your account and access to JessAI immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

9. Limitation of Liability and No-Fault Clause

IMPORTANT: Please read this section carefully as it limits our liability to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JESSAI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF JESSAI SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

YOU ACKNOWLEDGE AND AGREE THAT JESSAI SHALL NOT BE LIABLE FOR ANY FAILURE OR DELAY IN THE PERFORMANCE OF THE SERVICE OR ANY DAMAGES ARISING FROM THE USE OF AI-GENERATED CONTENT. THIS IS A NO-FAULT LIABILITY CLAUSE.

10. Indemnification

You agree to indemnify and hold harmless JessAI and its officers, directors, employees, agents, and suppliers from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the service or violation of these Terms.

11. Governing Law and Jurisdiction

IMPORTANT: This section determines where legal disputes must be resolved.

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles.

ANY LEGAL SUIT, ACTION, OR PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL BE INSTITUTED EXCLUSIVELY IN THE FEDERAL COURTS OF ALABAMA OR THE COURTS OF THE STATE OF ALABAMA. YOU WAIVE ANY AND ALL OBJECTIONS TO THE EXERCISE OF JURISDICTION OVER YOU BY SUCH COURTS AND TO VENUE IN SUCH COURTS.

12. Dispute Resolution

Any disputes arising from these Terms or your use of JessAI will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Alabama.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and JessAI regarding the use of the service and supersede all prior agreements and understandings.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of JessAI after changes indicates your acceptance of the updated Terms.
